Representative Assessee request rejected once again.

This query is : Resolved

16 September 2025 I had filed Representative Assessee request yesterday for the fifth time, but it was rejected once again by Income Tax Department. I have submitted required documents i.e. PAN card of deceased, Aadhar card of all legal heirs, Letter issued by SBI stating particulars of nominee as valid proof of legal heirs certificate, death certificate.
why Income Tax department is rejecting my request again and again, and due to this, I am not able to file ITR. I have also submitted grievance yesterday, but I did not get response/ feedback from Income Tax Department.
Also, whenever I have tried to contact IT department numbers, it was not connected.
now, I am confused about what to do?

16 September 2025 The department may reject your RA request for some technical or procedural reasons such as:

Nominee ≠ Legal Heir:

A nominee (as per bank records) is not automatically considered a legal heir for income tax purposes.

The SBI nominee letter may not be accepted as a valid Legal Heir Certificate by the IT Department.

Missing or Inadequate Legal Heir Proof:

Accepted proofs usually include:

Legal Heir Certificate issued by a Tehsildar or municipality

Surviving Family Member Certificate

Will or succession certificate

Court order declaring legal heirs

If you're relying only on the bank nominee letter, that may not suffice.

Document Format or Upload Issues:

Uploaded files must be clear, in PDF format, and within size limits.

The PAN of deceased and all legal heirs should be correctly linked and legible.

Mismatch of Details:

Names or DOB mismatch between PAN, Aadhaar, death certificate, and your RA application.

PAN of deceased should be active at time of RA submission.

Improper Selection of Relationship Type in RA:

The system may reject your request if incorrect relationship type is selected (e.g., "friend" instead of "son/daughter/spouse").

16 September 2025 1. Ensure Proper Legal Heir Proof

If you haven’t already, apply for a valid Legal Heir Certificate, such as:

Legal Heir Certificate from municipality or local Tehsildar

Surviving Member Certificate issued by local authority

Notarized affidavit along with death certificate, PAN, and Aadhaar (sometimes accepted)

SBI nominee letters are often rejected, as they’re not official legal heir declarations.

2. Re-Apply as Representative Assessee with Correct Documents

Use the IT portal:

Login with your PAN

Go to My Account > Register as Representative

Choose “Legal Heir” under the relevant deceased person’s PAN

Upload:

Death Certificate

PAN of deceased

PAN & Aadhaar of all heirs

Legal Heir Certificate / affidavit

Self-declaration by legal heirs (if needed)

3. Raise a Fresh Grievance on e-Nivaran

Even though you've already submitted one:

Go to e-Nivaran Grievance Portal

Select issue type as “Legal Heir / RA registration”

Mention that this is your 5th attempt and that you’ve already submitted necessary documents

Upload screenshots or rejection messages, if any

Clearly request specific feedback on the reason for rejection

16 September 2025 Email the Jurisdictional AO or CPC

If grievance doesn’t help within a week:

Find Jurisdictional AO (Assessing Officer) using the PAN search feature on the IT site.

Email them or visit in person (if possible).

You can also write to: ask@incometax.gov.in
or efilingwebmanager@incometax.gov.in

Visit local Income Tax Office physically with all documents.

Request manual approval of RA or assistance in filing ITR offline with acknowledgement.

16 September 2025 Thank you very much Sir. you have always helped me .and yes, I will try again to submit fresh request for RA and also, will raise new grievance . Thanks a lot Sir.
but, I have one query that why IT department is not accepting the required documents submitted by me even though they are as per the approved list of documents of Income Tax department. Sir, I already lost 1 month for getting Family pension certificate from Tresuary as valid Legal heir certificate as per the approved list of IT department, but it was also rejected. Then , I had to approach SBI for their Letter mentioning nominee of the deceased. Sir, I received form 16 of the deceased 15 days ago only that too frequent requests to Treasuary. so, I think, it is unnecessary hardship on the part of genuine assessees who want to comply with the rules and regulations. please, suggest what assessees have to do to avoid such troubles.

16 September 2025 As per your given data, I personally don't find any cause, it may be technical glitch. Contact your jurisdictional IT officer and file complaint in writing. If suggested, apply for RA offline. That is the only solution available at the moment.

16 September 2025 Good Luck.
