13 February 2012 You can write a letter for condonation of delay due to unavoidable reasons and present before the AO in current date and submit the documents.

It will depend upon the officer to take action or not.

21 July 2025 Hereโ€™s a clear, professional draft for your reply to the notice u/s 221(1) including a request for condonation of delay and guidance on the affidavit:

To
The Assessing Officer
Income Tax Department
[Address]

Subject: Reply to Notice under Section 221(1) of Income Tax Act and Request for Condonation of Delay

Respected Sir,

I refer to the notice issued under Section 221(1) dated [date of notice] regarding the presentation or submission of documents in support of the tax deposited by 25/01/2012.

I am a salaried individual who filed my Income Tax Return for the relevant assessment year along with TDS details, and I did not claim any refund.

Unfortunately, due to unavoidable reasons, I was unable to appear before you or submit the requisite documents by the specified date. However, I am submitting now the following documents for your kind consideration:

Form 16 (TDS Certificate)

Copy of Income Tax Return (ITR) filed

In this regard, I humbly request you to kindly condone the delay in submission and accept the enclosed documents. I assure you that there was no intentional delay on my part, and the documents are being provided now to comply with your requirements.

Regarding the affidavit:
I understand that sometimes an affidavit is required along with the application for condonation of delay. If deemed necessary, I am willing to provide an affidavit duly sworn before a Notary Public. Usually, a stamp paper of Rs.10 or Rs.20 is sufficient for such affidavits related to procedural delays. However, please advise if a specific amount is required.

I kindly request you to consider my explanation and accept the documents to resolve the matter at the earliest.

Thanking you,
Yours faithfully,
[Your Name]
[Your PAN]
[Your Contact details]

A few quick notes:
You can submit Form 16 and ITR now, even after the due date, by explaining your delay.

Attach a simple affidavit stating the reason for delay if you feel it adds strength to your case.

Stamp paper of Rs.10 or Rs.20 is typically sufficient for affidavits related to income tax procedural matters.

Always keep a copy of everything you submit and note down the submission date.
