Rent income of nri

17 November 2012 Hi,
I am working with a Bank and I am getting lease rent facility from the employer. My land lord is a NRI residing in France. I have been informed by my employer that the rent is taxable and will be deducted at source @30.90%. My query is;
1. Whether the land lord can get the tax refund in India (for the rental income)if he files ITR if he does not have any other income in India?
2.Also, I have come across some article in which it is mention that the NRI can go for lower rate of TDS after filing some form with the Income Tax Department. Need your guidance in this regard.

18 November 2012 1.The land lord can get refund subject to his the computation of his taxable income.

2. For lower rate deduction of tax you may refer the procedure prescribed U/s 197 of the Income Tax Act.
