03 May 2009 In case there is a mistake in calculating the amount of penalty, can the order u/s 271(1)(c) of the I. T. Act be rectified u/s 154 of the I. T. Act?

03 May 2009 Penalty order can be rectified,provided the mistake is apparent on the record and is an obvious and patent mistake and not something which can be established by a long drawn process of reasoning on points on which there may conceivably be two opinions.

04 May 2009 Any order passed by an authority defined u/s 116 of the IT Act is rectficable u/s 154, however it can be rectified only to the extact as BC has clarfied above.
