Re export from port itself without clearing or bonding

Hi,
We have one Shipment in chennai port , we don't have IEC and it is under process.
We have dummy IEC .
In this situation
1. Can we sent back that shipment to supplier.
2. can we re export (sales ) to other country.

AS PER FOREIGN TRADE POLICY PARA
2.8 (III) AN EXPORTER / IMPORTER IS EXEMPT FROM IEC CODE IF THEY ARE IMPORTING / EXPORTING THE GOODS FOR PERSONAL USE / AGRICULTURE PURPOSE.
AND IN YOUR CASE IF YOU IMPORT/ EXPORT THE GOODS FOR NOT PERSONAL USE CAN BE IMPOSED A HEAVY CUSTOM DUTY AND DRI / PREVENTIVE DEPARTMENT OF CUSTOM WILL SEARCH AND BLACKLISTED YOU.... YOU ARE ON WRONG WAY..
