19 September 2013 Sir/Madam,

We have received sub contract relating to "excavation work for a new Railway Project".

My Querry is whether Service Tax is Payable on the same by sub contractor.

22 September 2013 Services by way of construction, erection, commissioning, or installation of original works pertaining to railways are exempted from service-tax.
Works contract service provided by the sub-contractor the contractor for exempted works contract is also exempted.

Excavation work is original work pertaining to railways and exempted from service tax and hence subcontract relating thereto is also exempted
