SUPREME TECHNOLOGY IS PARTNERSHIP FIRM HAVING HO@NAVI MUMBAI & BRANCHES ALL 4 METROPLIATIAN CITY. IS IT NECESSARY TO PAY PROFESSION TAX BY US @EACH STATE WERE ALL OUR BRANCHES R SITUATED. KINDLY ADVICE & SUGGEST------Thanks & Regards

27 August 2012 In Maharashtra Partnership firm is not liable to hold EC or to pay profession tax but partners are individually liable to pay tax u/e 19, of schedule appended to Act. Firm is liable to deduct and pay tax out of salary paid exceeding Rs. 5000/- P.M.

There is diff between Profession tax & Professional Tax. Profession Tax is paid for runing business on the land of that particular State & Professional Tax is dedcuted from Employee Tax. Our Query is whether partnership firm is liable to Pay Profession Tax / Businees Tax in Every State were-ever office is situated.

29 August 2012 Provisions of Profession Tax are varying in different states. In Maharashtra Partnership Firm is not liable to hold ENROLLMENT CERTIFICATE and is not liable to pay profession Tax for carrying business. Partners of firm are liable to pay profession tax if the firm or branch is engaged in business in Maharashtra.
Partnership firm or any person paying salary exceeding Rs. 5000/- to employees is under obligation to hold REGISTRATION CERTIFICATE under Profession Tax Act and has to deduct amt. of tax out of salary payable as tax to be deposited with State Govt.
