21 March 2012 Dear All Experts,

My query is, if an employee "A" is getting "X" amount of salary and according to the salary structure for all the employees of the firm, "A" is liable to get his PF & ESIC deducted from his salary. After couple of months there is a hike in "A's" salary, and after the hike "A" did not comes under the category of those employees who PF deduction is mandatory.

Now my question is will there be a deduction of PF from "A's" new salary?

If it is so, then to what extent, i mean will it be to the maximum limit of salary structure of employees of the firm or will it be to the extent of the new salary of "A"?

10 August 2024 **Scenario: PF and ESI Deductions Post Salary Hike**

When an employee's salary changes and the new salary exceeds the mandatory coverage limits for Provident Fund (PF) or Employees' State Insurance (ESI), the following guidelines generally apply:

### **1. Provident Fund (PF)**

**1.1. **Employee’s PF Contributions:**

- **Existing PF Coverage**: If an employee's salary initially fell below the ₹15,000 per month threshold for PF coverage, both the employee and employer would have contributed to the PF.

- **Post Salary Hike**: If after a salary hike, the employee’s new salary exceeds ₹15,000, the PF contributions should still continue. However, the contributions will typically be capped at the threshold of ₹15,000 for the purposes of calculation, based on the mandatory PF contribution rules. This means:
- **Employee Contribution**: Calculated at 12% of ₹15,000 (i.e., ₹1,800).
- **Employer Contribution**: Similarly calculated at 12% of ₹15,000 (i.e., ₹1,800).

- **Limit of Contribution**: Even if the salary exceeds ₹15,000, the contribution is calculated on a capped limit of ₹15,000. The excess salary above ₹15,000 does not affect the PF contributions if the company is adhering to statutory guidelines.

**1.2. **Employer’s Option**:

- **Voluntary Higher Contributions**: Some companies choose to continue contributing to PF on the entire salary even if it exceeds ₹15,000. This is often done to maintain a uniform benefit for employees.

### **2. Employees' State Insurance (ESI)**

**2.1. **ESI Coverage**:

- **Initial Eligibility**: ESI is applicable if the employee’s salary is up to ₹21,000 per month.

- **Post Salary Hike**: If the employee’s new salary exceeds ₹21,000, ESI deductions will cease since the employee is no longer covered under the ESI Act.

### **Summary of Actions:**

1. **PF Deduction After Salary Hike**:
- **Mandatory Contributions**: Continue to be calculated up to the maximum limit of ₹15,000.
- **Salary Above ₹15,000**: PF contribution is capped at ₹15,000; anything beyond this is not covered for PF contributions.

2. **ESI Deduction After Salary Hike**:
- **Exceeds ₹21,000**: ESI deductions stop once the salary exceeds ₹21,000 per month.

### **Practical Steps for Employer:**

- **Adjust Contributions**: Ensure PF contributions are adjusted as per the capped limit if the employee’s new salary exceeds ₹15,000.
- **Update Records**: Maintain accurate records and ensure timely updates to payroll systems to reflect changes in contributions due to salary hikes.
- **Communicate Changes**: Inform employees about the changes in contributions and how it affects their benefits.

### **Conclusion:**

The PF contributions will be based on the maximum limit of ₹15,000, even if the employee's salary exceeds this threshold after a hike. ESI contributions will cease if the salary exceeds ₹21,000. It’s advisable for both employees and employers to review company policies and statutory requirements regularly to ensure compliance.
