INCOME TAX RETURN FOR CITIZENS WORKING ABROAD

This query is : Resolved

14 August 2023 Are persons working abroad required to file income tax returns in India even if their stay in India is less than 182 days and if their income is below taxable limit. DDIT issued notice calling for assets held abroad.
Can the experts throw light in this aspect please....

14 August 2023 If any citizen of India stayed less than 182 days in India in any particular year, and also in aggregate less than 365 days in last 4 years preceding the year, then he is NRI as per sec. 6 of IT act.
If the aggregate income of an NRI, earned or accrued in INDIA is less then the basic exemption limit provided in the IT act, then he is not required to file ITR for that relevant assessment year.
Based on that you can reply to the query from DDIT.
