For a person who missed filing Income Tax Return (ITR) for FY 2022-23 (AY 2023-24), here are the alternatives and options available: 1. Filing a Belated Return As per Section 139(4) of the Income Tax Act, a taxpayer can file a belated return for FY 2022-23 on or before 31 December 2024 (i.e., within 2 years from the end of the relevant assessment year). The belated return is allowed but may attract a late filing fee and interest. 2. Late Filing Fee Under Section 234F, a fee is applicable for late filing: ₹5,000 if filed after due date but before 31 December of the assessment year. ₹10,000 if filed after 31 December but before the end of the relevant assessment year. However, if total income is ≤ ₹5 lakh, the late fee is ₹1,000. 3. Interest on Tax Due If there is any tax payable, interest under Section 234A (for delay in filing) will be applicable. 4. If Return is Not Filed The income tax department may send a notice and initiate penalty proceedings. There is no special condonation or extension unless notified by the government. 5. No Prosecution or Penalty for First-time Delay (Usually) If the delay is genuine and the return is filed soon after the due date, penalties may be waived in some cases.
