Income tax refund

I was suppose to receive Income Tax Refund of A.Y. 2009 - 10 but when I received order u/s 143(1), CPC Banglore, they have illogically adjusted this refund against the prior liability whereas that liability does not exist. So now do i need to file the recitifcation now? What is the procedure?
