Gift tax

This query is : Resolved

01 May 2016 hello sir,

I would like to know that whether gift received from son of spouse's sister (sali ka beta ) of rs. 100000 is tax free or taxable?

also tell me if my spouse's sister's husband (sadu) takes gift from his son & then gift that amount to me is tax free or taxable?

& if it is taxfree, can Income tax department raise any question?

regards:

girish shah.

04 May 2016 No.1, Sali ka beta is not covered under relative so any gift above Rs. 50000/- is fully taxable.
No.2, You can take gift from your sadu i.e. sister's husband as he is covered under relative but sadu first taking gift from his son and then making the same amount as gift to you may raise some income tax queries as to why the transaction was so routed. It is better to take gift from sali or sadu directly.
