Quick Summary

For salaried individuals without business income, filing Form 10IE separately is not mandatory when opting for the new tax regime. 09 September 2021 Is it mandatory to file form 10IE for salaried individual having no business income? If yes, the nature of Business is being questioned in such form.And If No, how to delcare in the return that new income tax regime is opted?

09 September 2021 For assessee filing ITR 1 & 2, filing form 10IE separately, is not mandatory. They can opt the new tax regime, by just clicking option "YES" while replying to question (in ITR) "Are you opting for new tax regime u/s. 115BCA?"

09 September 2021 E-filing of form 10IE is not mandatory if new tax regime is opted by an assessee who has no income from business/profession.

Naure of business will not be questioned since no business.

In form ITR-1/ ITR-2 (Part A General information) column is provided where in tick mark yes/no as the case may be.
