Dear expetrs
From last five years esic inspcation esic inspector raise liability from balance sheet for expenses of building,maintanance and other labour charges paid . Most of this type of labour/repairing and maintanance work is done from contracter who is registered with esic and paying esic regullary for his employees.
I want to know that is it necessary to pay esic for this type of liability? Also want to know the how this type of esic liability is occured only from maintances/reparing and jobwork or on employee who is doing work for job work?How can we go for appeal for this querry?

Principal employer responsiblity pf ESI coverage for all the employee whether direct employee or contrac employee. Incase the sub contractor himself register under ESI and paying properly for their employees ESI, then you need to collect the proof of payment and ESI coverage and submit to the ESI department. no need to pay again by the Principal employer
