ERROR WHILE FILING UPDATED RETURN IN OLD TAX REGIME

Quick Summary

Query on error while filing Updated Return u/s 139(8A) under old tax regime. It was clarified that if the original return was not filed under old regime within due date (along with Form 10-IE), updated return cannot be filed in old regime. The taxpayer must proceed under the default new tax regime.

02 January 2026 I HAVE FILED LAST YEAR (AY 2024-25) RETURN UNDER OLD TAX REGIME , FOR THIS YEAR I AM FILING UPDATED RETURN UNDER OLD TAX REGIME BUT THE ERROR IS SHOWING BY SOFTWARE THAT " DEAR USER, ORGINAL RETURN WAS NOT FILED FOR THIS AY , SO YOU WILL NOT BE ABLE TO PROCEED TO FILE UPDATED RETURN U/S 139(8A) WITH OLD TAX REGIME" SO IN THIS REGARDS PLEASE PROVIDE ME GUIDANCE HOW TO PROCEED....

03 January 2026 Correct. If you have not filed original return(in old regime), you have to file the updated return in default tax regime, which is new regime.

03 January 2026 Due date of filing form 10IE for AY 2025-26 was 31.07.2025. Now you cannot file ITR under old regime.
