Is there any way out to net get penalty of Rs. 5000

The penalty u/s 271F may be levied and not a must for the same.
However it can be levied only if same taxa payable is outstanding to be paid. If no tax is payable on income or already TDS & advance tax is sufficient for ur income then penalty may not leviable and u have a case to agrue against the A. O. for the same.
