21 April 2011 There is no DTAA b/w India and Hongkong. There is a transaction b/w these countries where in payment is being done from India to Hongkong for the services rendered in China by a person in Hongkong. Now should the payment must be made after deduction of TDS??
If so at what rate?? Which sec of IT Act describes it?

22 April 2011 TDS on transaction with non residents falls within section 195.

However information supplied by you are insuffient........

22 April 2011 Payment is being made for what kind of services. Kindly give exact details?

Also clarify whether the said services were used to earn any income from outside India?

22 April 2011 A lecture was arranged by a Indian company in China where in a professor from Hong Kong delivered a lecture in China. Students attended the lecture paid US$ to the Indian company.

22 April 2011 No TDS needs to be deducted on the said payment under sec. 9(1)(vii)(b)of Income Tax Act,1961.
