Do excess leaves during articleship affect final attempt?

25 February 2013 sir, whether excess leaves during articleship affect my due attempt of finals? whether 2 and half year completed from registeration is considered or 2 and half years actually attended is considered?

25 February 2013 2 and half years actually attend shall be considered. For you clarification one example here.

Assume actually your articleship of 3 years shall be completed on June 2013 then you are eligible for May 2013 but due to the excess leaves your articleship shall be completed on or after November 2013 then you are not eligible for May 2013 because as on May 2013 you are not in the last six months of servicing period and you are in the last 7 months of articleship period. So including excess leaves your articleship shall be completed on or before October 2013 then you are eligible for May 2013 attempt.

As per Regulation 50 of the CA Regulations, 1988, a student will be eligible to appear in Final Exam, after completing of 30 months (2 Years and 6 months) of article ship.

The eligibility of leave will be 1/6th of articleship served. If leave is in excess then your article ship will extend accordingly.
