Directorship in light of service tax provisions

26 October 2012 I would like to seek clarification on the following two points if possible :-
1. Is there a way to know whether a Company's existing Director is an Executive or Non Executive one since we are not being able to locate from past records.
2. whether a person may be appointed as a MD ot WTD in more than one Private Limited Company - this is still not clear due to different opinions on the subject.

Yes, you can check from e-Form-32 filed with ROC, the details about executive or non executive will be mentioned in form.

The provisions of appointment of MD/WTD/Manager given under companies Act, 1956 will not apply to private limited company unless they are subsidiary of public limited company they are govern by their articles.

So a person can be a MD in more company.
