06 January 2016 Dear Experts, i am individual has taken contract from construction company to paint it's flats however materials is to be suppy by company plz let me know weather it is covered under work contract or supplying labour... plzz response quickly.. thanx & Regard anuj Goyal

06 January 2016 Your contract is for painting the the flats, not supplying labour, so it is works contract.

06 January 2016 but sir my CA has said if No contract Deed is made also No materials is supply by you therefore it is covered supplying labour hence company will pay 100% ST under RCM.. plz guide me...

06 January 2016 I agree with your CA that you receive payment based on manpower engaged in the work.

06 January 2016 If you get payment based on manpower supplied for the work it is manpower supply.
