I am not claimed Service tax in bill from the past 1 year, now i claiming and party is ready to give service tax, in return i will also pay to department. whether it attracts interest and penalty.

if you not claimed the service tax on bill, it will be deemed to service tax has been including in the bill value and in that case your service tax liability will be calculated on gross amount received.
