death of assessee

22 December 2010 sir in my case, refund of assessee is due for A.Y. 2008-09 & 2009-10. Assessee died on 12 oct 2009.
Local income tax office is not issuing cheque in name of his son (no will is there).
What is the remedy with my side?

23 December 2010 Write a letter to the Income-Tax Officer enclosing Death Certificate of the assessee

and

give a declaration to him about the person who is legal heir of the assessee.
