07 December 2013 Suppose A Received a Delivery oredr of coal from SECl in his name &
directly sold the delivery order to B & goods is received by B directly from SECL .
My query is that can B will be treated as 1st stage dealer & transfer the excise.
& if not than is there is any other way by which B can transfer the excise to another dealer.

07 December 2013 yes A is treated as 1 stage dealer and can pass on excise duty to B.

09 December 2013 But my query is whether 'B' can be treated as 1st stage dealer because goods are directly received by 'B' as if he cannot then 'B' is unable to transfer the excise received from 'A' to another dealer.

09 December 2013 The ans is no,
as first stage dealer as per excise includes only those who directly purchase from manufacturer and here first a purchases but directly ask b to collect as he resales it.
