Customs duty on replacement

Hi
I have import a material six months back and now this material is got defective and supplier is ready to supply new piece FOC against the same, so pls. confirm, will i have to pay customs duty in this case

If you are returning the defective material then in import you can get it mentioned then no duty is payable

My consignment just arrived in customs and our CHA confirmed that there is no benefit on replacement items and we have to pay customs duty as per Exim Code. Our CHA also confirmed that if we send a item for repair and return, in that case duty will be paid only on repair cost.
