This query is : Resolved

Quick Summary
This discussion addresses the common problem of Tax Deducted at Source (TDS) credits not being correctly applied in income tax intimations, even when reflected accurately in Form 26AS. When rectification requests under section 154 are also rejected, individuals are seeking remedies. The advice suggests investigating the specific reasons for denial with the Income Tax Officer (ITO) before considering an appeal to the CIT Appeals.

15 August 2023 In the income tax intimation under section 143 (1) credits not given properly and fully. Entries are found proper in Firm 26AS. Still Demand is raised in many cases. i filed rectification request under section 154. Even in such rectification orders credits of tds refused. What is the remedy for this. Can the experts tell a way out of this dilemma. Not only credits refused but huge interest also levied in such cases....

16 August 2023 There must be some reason/s for denial of TDS, be it not confirmed by the creditor, or the relevant income not declared in ITR etc. etc.
Each case needs physical verification of the defect/s. Only after that the further step/s can be advised.

16 August 2023 Thank you for your kind reply sir. If it is found that there are no defects can the assessee an appeal before the CIT appeals after the receipt of the rectification order rejecting the claims of TDS. Kindly clarify sir.

16 August 2023 I cannot agree to the rejection of the claims without any defects.
You may not get justification in appeal if the defects are genuine. First check the reason of the rejection/s from your ITO.

10 September 2024 Good Luck.
