11 August 2009 Dear Expert,
Can one resident indian and one non-resident indian start a private ltd co in India? (both are husband and wife - husband doing business in india and wife doing business in dubai). Is any special procedure required as one of the director is NRI? Thanks in advance.

11 August 2009 Yes, they can form a Private Limited Company. No special provision is required to be followed under the Companies Act, 1956. However, the proof of remittance of funds will be required (as one of the subscribers to the Memorandum and Articles of Association is an NRI). Form FC GPR is to be filed with RBI. In case the NRI is also going to be appointed as a Director, then obtaining DIN number would require more documents than an indian resident.
