16 January 2013 Sir we are engaged in trading of rice and exporting the same .for this we purchases packing bags including excise duty .

1.whether we are eligible for cenvat credit of duty paid on bags ?

2.whether we are entitled to refund for the same if not able to setoff against duty liability

3.whether packing bags covered under amended definition of input as per CCR rules 2004.

4.whether rice are our final product as defined undere ccr rules 2004.

After considering the above 4 points please suggest me the appropriate treatment for the same and if appropriate suggest any case laws for the same as well.

16 January 2013 Two way is available for export of goods.
1. You can take the rebate after exported the goods.
2. You can get the inputs without payment of central excise duty under rule 19(2) of central excise rule 2002.
