a firm had taken service tax registration in 2008. after that they have not submitted return yet. now they want to cancel the registration. i would like to know what is the process to cancel the registration and how much will be the legal expenses.

i) Service tax returns from 2008 to June 2012 has to be filed.
ii) Thereafter, follows the procedure given here under to surrender the registration. Visit www.aces.gov.in Create userid and password if not yet created. login to the site. click on 'REG'. Click on 'surrender'. click on 'registration number'. fill up the last three columns in the ST-2 appearing therein. click on 'surrender ST-2'. On successful e-filing, take a print out sign and seal, enclose original ST-2 and file before the jurisdictional superinte- ndent under acknowledgement.
iii) No fees has to be paid to govt for surrendering ST registration.
may i know how much will be the late fine if the firm (individual) have not submitted any return from the registration...if he submits nil return. he has taken registration on 2008.

Late filing fee( penalty) is governed by rule 7C of the Service tax Rules,1994 and depends upon the number of days delay ranging from Rs. 500/- to Rs. 20,000/- per return. However, in case of NIL return the authority has power to waive the late filing fee (penalty)as per the proviso to the said rule.
