My friend provide software related help to his us friends n in turn got 80000 as professional fees , can he classify it as business income and claim depreciation since being a salaried person depreciation benefit gets lapsed and also internet and telephone billing gets lapsed

I had provided software related help to us friends and in retutn I got 80000 as fees , will I on the basis of this receipt can claim depreciation in my income tax return since I am a salaried person and depreciation on my activa and laptop gets lapsed and also the internet billing and telephone expenses

In the year 2009-2010 i filled my tds and after some time received a cheque of rs. 12000as my refund . But the account on which that cheque was issued was closed so i returned the cheque to issue it in my some other account. But till now have not received anything.Now what should i do know to take my refund .
