I have read and heard that The rates prescribed under India companies act under 1956 for depriciation are bare minimum rates. One can go for higher rates of depriciation also.

Does any conditions are attached in claming higher rates of deprication ?

Is there any case law or judgement of rules which provides for the resonability of higher depriciation?

If reasonable cause is the condition, how a reasonable cause be defined ?

Other attached conditions/informations in this regard.

Please help me out in respect of this query

Depreciation under Company's Act, 1956

U/S 205 & 350 there is defined bare minimum depreciation rate for different assets, my question is if we want to depreciate an asset at more than the rate difined under company's act, how can we do so.

Form 108 - Query on Articleship

I completed Articleship on 21st Nov 2007. Took total of 191 days leave during the three years of articleship. In the meanwhile I had accumulated credit leave of 30 days during the articleship period itself and the balance was agreed to be served by me during the month of December 2007. My boss is agreeable to sign the Form 108 showing 138 days as leave taken (thus resulting in no excess leave) and we want to avoid the prospect of sending Form 107 (Supplementary Articles). I checked with my other CA friends who had completed their articles and they informed me that they had followed the same procedure in their cases too. Just want to check with the Experts as to whether this arrangement can be done so as to avoid the documentation and hassle of Form 107 and then Form 108 after the completion of Excess leave service.Please help soon.

CONSEQUENCES IN SERVICE TAX

party 1 has raised a Performa Invoice for Rs. 5,00,000 and then a final bill for the same amount.
Now, Party 2, to whom the bill is raised has paid TDS for both for the Proforma Invoice and the final bill.
So, what are the consequences and how can they be solved.

Degree Dilemma

Thanks a lot for your kind response Sir,
As you said earlier that a CA without any basic degree cannot get Masters degree,then what are the other best options available aparting from Distance education to pursue higher education.
It was only my sheer devotion to the course & respect for the knowledge ICAI imparts made me to leave my Degree Final year.Now am bit disappointed that I cannot be a Post Graduate.Can a CA without any degree do Masters course from ICFAI,also kindly advice how much of points(bacculards)are generally alloted to a CA (without a basic degree) to pursue CPA in USA

My friend has a properietor ship busines.
He has PAN in his own name.
can he obtain new PAN for his properietor ship concern?
he need PAN in his busines name because he have to coat this when he submit application for any auction.

DEDUCTION FOR PRECLOSURE INTEREST CHGS

We know that while Housing Loan is preclosed, there would be preclosure interest charges @ some% of the principal oustanding on the date of pre-closure.

My query is that whether the same can be treated as Interest under House property in the year of sale of house property as it is necessarily a interest cost on the housing loan & deductible under Sec 24.

If YES, please confirm as to whether there are any decided cases on this?

IF NO, Please confirm, whether it can be treated as COST OF TRANSFER of the capital asset (house property) and be taken AS DEDUCTION in computing CAPITAL GAIN
