VAT of supply of machinery

We are giving construciton equipment on rent to any person without transferring right of possession and effective control of such machinery with in India . The machinery operation and maintainence is with us i.e our operator's do the work as per the requirement of the client.

Please advise the applicability of the VAT on the said transactions across India.


Further can we take the MODVAT credit on equipment purchased and use the said credit against the Service Tax Liability

ESOP Trust

Private limited company-closely held has created one trust for the purpose of ESOP.

Do this trust required to be regitered under Income tax Act,1961. If yes, under which section it needs to be registered?

Medical Reimbursement


Medical Reimbursement is applicable for employee's family i.e. his father, mother , brother , spouse etc.
If both father and son is working in different organisaion and medical reimbursement on the basis of same bills as photocopy of bills are presented.
Is it right or not.
If not how can it be avoided????

maintaince of books

sir, i am dealing in purchase and sales of shares on delivery basis. if my sales exceeds 40 lacs then i have to audit. we have received three statements from our broker 1) contract notes 2)profit&loss account 3)ledger . by providing all these statements to my CA, audit will be possible or not. i know audit is neccesery of all all the above three statements but regular books as a businessman prepares ,how it can be possible in our case when we have only above three statements. pl carify.

When some services rendered by a unit are subject to Service Tax and separate accounts are not kept for each service, then how will be treatment for taking CENVAT credit? Please reply as per latest amendment of 2008.

Whether Medical facility other than Reimbursement up to Rs. 15000/- i.e. ( in emplyer's hospital or any other hospital u/scheme CGHS attracts penalty?????
