STCG CALCULATION

if i have a salary income of Rs.80,000/- and short term capital gain is Rs.70,000/- (STT paid)

should i pay tax on Rs.70,000/- @ 10%

Should I pay tax on Rs.40,000/- @ 10% (i.e. 70,000+80,000-110000 exemption limit)

Should i reduce STT from my capital gain income

What benefit can i gain from STT paid

SEC 269SS AND SEC 269T

this is with refrence to section 269SS and T

if i had taken a loan of 4.5 lacs and repay the party 5 lacs then whether i will be showing repayment as 4.5 lacs or 5 lacs.

if i had accepted security deposit for different reasons from the same party then whether i will be clubbing the amount or show it seperately(i have made the individual acconts seperate)

tds treatment if part certificate is recd

I have one query that I have a rent agreement with company A."A" deducts tds on my rental income. But is giving me tds certificate only for 10 months though he has deducted for 12 months. Now my question is how do i treat this in my return whether 10 or 12 months.

A is saying me that he will provide the certificate for 14 months in next financial year.

Please tell what are the consequences for me & even for A.what are the penalties which he will be imposed.

How will I prove myself infront of Income Tax Officer.

Thanks & Regards,

Shobhit Singhee

We regularly hire trucks from truck stand for despatch of consignment.

There is no formal contract with any of the truck /tempo owner.

They are called from stand as & when required.nervethless payment to single party during the year to a party exceeds Rs. 50000/-. will this attract the tds given the nature of transactions.
