Incorporation of new company

It is learned that 98 sections of Companies Act 2013 has been notified in the official gazette. I also came to know that as section 465 of new act is not yet notified, Companies Act 1965 is still in force.

Under these circumstances, will I be able to incorporate a new company under Companies Act, 1956 till the day section 465 of Companies Act 2013 is notified? I was in the middle of incorporating a new company. I had already received consent for name. I was about to upload Form 1, but as sections of Companies Act 2013 are notified, I got confused. Thanks in advance

Direct tax

I want to know whether my treatment to following transaction is correct or not.
Facts:-
An Assessee is allotted a plot by HUDA in faridabad by draw of lot in 2006, in regard of which he pays certain sum in 4-5 annual installment till 2012(amount :approx 4 lacs).
Now in 2013 he decides to sell this plot in 2013, for which he registers this property in his name from HUDA in 2013 & subsequently sell this plot for 23 lakhs. Assessee is already having another house in which he resides.

Confirmations Required on following:-
1) The plot becomes Capital Asset of Assessee in which f/y,
a)2006-07 (in which he is allotted the plot) or
b)2013-14 (in which he gets plot registered in his name from Huda)

Thank you for your Replies in Advance.

Gifts from relatives

Does gifts received from specified relatives
should be shown in I T Returns.

Gifts from relatives are capital receipt or
income receipts.

Is there any caselaw regarding this.

Does section 10 of income tax shows that
Gifts from relatives as exempted income.
