Vat on newly purchased flat.

Dear Sir,

We seek your expert advise on...

We have been purchased one residential flat in the year 2009 which was under construction and now it is ready for possession.

I have been made full payment of the flat cost and other additional charges i.e corpos fund, electric charges, one year maintenance etc.

Now the builder is asking to pay Service Tax and 1% VAT on Flat cost otherwise he is refusing to give me Possession.

Please guide me whether VAT & Ser.Tax on property is to be born by builder or customer?

I heard and read somewhere that it is to be born by builder. If so please guide me for further necessary action.

Relife under section 87a

Please suggest if a person net tax able income is 2,25,000/- before claim exemption of Rs 2,00,000/- tax paid on Rs 25000/- @ 10% is 2500 plus Cess @3% is 75 on which amount tax refile U/S 87A is claim either from 2500/- or from 2575/- or cess calculate from 2500-2000 =500 @3% 15 my question is from which amount cess is calculate either 500 or 2500/-

Tcs on jewellary

While undergoing section 206C(1D), I got a query. My question is what is the meaning of "any amount in cash as consideration" in case of sale of jewellary.
For eg. If a person purchases jewellary for Rs. 550000 and make payment partly in cash of rs. 100000 and remaining through cheque. so how TCS shall be attracted?
Whether TCS is to be collected on whole amount or parly payment in cash of Rs. 100000?

Interest on loan or depositer

Sir,

I want to know how much interest rate is allowable in income tax act for f.y 10-11.I have proprietory business and We paid Interest to loans taken from relatives and interest paid 18% p.a on loan amount.We also deduct tds 10% from Interest and paid via chalan and also filed our tds return.Our Depositer also files his personal return.And also mentioned interest income in his return and also paid selfassessment tax on his personal income.So i want to know that the assessing officer disallow the interest rate 18%.Kindly any judjement in this matter as per your knowledge please give reference.

Cenvat in in-transit sale

Hi,

Please suggest which should be the supporting document to claim Cenvat under In-Transit Sale (E-1 Sale)?

ABC bought goods from XYZ. XYZ ordered the same from PQR premises and PQR raised excisable invoice as Bill To- XYZ and Ship to ABC?

Can ABC claim Cenvat on PQR invoice even if it is billed to XYZ?
or
Will it be XYZ's dealers invoice to claim the Cenvat?

Urgent

Dear Sir,
In one case assessee has agriculture income of Rs. 4 lacs and his non-agriculture income was below the exemption limit about 1.5 lacs in FY 2011-12.
If he files his income tax return for the AY 2012-13 now then penalty for late filing and tax will attract or not.

Hi everyone,
my query is we are manufacturers established in Himachal Pradesh and enjoying the exemption till 28th nov 2013. after that we are under excise . now the problem is we are receiving the bills of tax auditors on which we have paid service tax . now the amount is for the audit of whole year but that time we were non excisable and at the time of bill we have goods in our godown having goods made at the time non excisable tso kindly guide whether we can avail the inout credit for the service tax paid
