Service tax on maintainig of road, gardenig

We are a Public sector, we have outsourced the maintenance work towards roads , garden, staff qtr admin bldg . Contractor charging 50 % ser tax & we are paying bal 50% under reverse charge mechanism. Doubt arise whether the above service tax is eligible to take credit or not. please advice the right one.

Work contract

Material Cost @67% calculated on Taxable Amount and Labour cost 33% calculated on Taxable amount, service tax calculated on Labour cost (33 x 12.36% = 4.0788%). 4.0788% calculated on total Taxable amount.

Material- 1,59,01,413 x 67% = 1,06,53,946.71.
Labour - 1,59,01,413 x 33% = 52,47,466.29

Service Tax - 1,59,01,413.00 x 4.0788% = 6,48,586.833
Service Tax - 52,47,466.29 x 12.36% = 6,48,586.833

Is it Correct or not????

Branch (trading) expenses - credit

We have branch in all state for Trading Activity. Shall we can take that expenses (like: Courier,Telephone,Rent) as credit in Service Tax

If any Man Power supply company is hired and charge Management fees + Salary to be paid to the outsourced employee (Employee are on Man Power supply Companies payroll)is service tax to be levied on the salary component also. for Example

Salary 100
Managment Fees 10
Total Charges 110
Service tax will be on Rs 110/- or Rs 10/-.

If the Company bill by showing Rs 100 as reimbursement towards salary paid to the employee on behalf of the company than what shall be the case

Service tax registration

Dear Friends, I am doing business of travelling and have turnover of Rs. 1400000/-. Expenses for Diesel is Rs. 600000/-. what will be limit to registered under act whether it is 1400000/- or 800000/- ? Direct Expenses are considered to determine value taxable service? plz help its urgent Thanks to all

Dear sir,

Please help me to know the applicability of service tax in following case :-

ABC Ltd.(contractor) make a contract with government Agency
(contractee) to construct a hospital. Now ABC Ltd (contractor) make
further contract to sub- contractor like labour contractor (eg. X) to
provide the labour on construction site, other sub contractor (Y) to
work on site at measurement based labour rate, sub contractor (Z) to
work on site with material i.e. work contract, and Security Agency to
guard the construction site.

As per my knowledge of service tax M/s ABC Ltd. i.e. main contractor
is exampt from service tax as per Para 12(c), and sub contractor (Z)
is also exampt as per Para 29 (h) of service tax. but my question is

(1) Should service tax Applicable on Sub Contractor (X), (Y) and
Security Agency.

(2) Should Reverse charges Applicable on M/s ABC Ltd. i.e. main
contractor in case of labour supply contractor, security service ,
Jobwork and work contract.

Service tax on cancelled flats

Hi all,

Please resolve this issue, it is very urgent.
I booked service tax payable at the time of flat booking & deposited it to the department on the right time.
Now for some reason the particular flat's booking is cancelled but we have not refunded all the amount to the party, we will make payment in future & it is confirmed by the party also.
Now, my question is, may take the service tax credit on whole amount.

Please suggest.

Voluntary disclosure scheme

sir,
My company has various units for the Finance section in different places.

One of the finance units where i am in has paid off the ST liability recently. we need to file form VCES 1 disclosing the payment made.

My doubt is
1) whether the company as a whole need to apply form VCES 1 after making all the payment
2) or we can apply form VCES 1 as an when we make those payment.

Is invoice amount included service tax

A company which is under process for taking Service tax no. and TIN No. but it raised the bill included taxes.
Could you please guide us how we can we raise the invoice without the tax numbers.
If service tax applicable or if not.

Please tell me ,
we are a Pvt Ltd company and we got a contract from L & T of Run way excavation for domestic airport. We have engaged our machineries along with labour etc for the work.

SO MY QUERY IS 1. Whether service tax will be charged on any construction work we do.

2. Whether service tax will be charged on machineries we have engaged and also on labour

3. since this is a airport work is this services are exempted.

please guide
