Excess Service tax

Dear

We have paid Excess Amount in Service tax Category - Business Auxiliary Services. Can we adjust this excess amount in the another Category - i.e. Maintenance or Repair Service or any other category for future payments.

Please advise.

Service tax on advance payment

We received an advance money claim from our service provider on which he charged service tax. WE understand that the service tax is to be remitted by receipient of advance money. but is it mandate for a person to pay the service tax while making advance payment to his vendor.

Service tax on exports

During the FY 2003-04, I (proprietorship firm) have received commission > 4 lakhs from a manufacturer in India towards export order procured by me. The goods were exported by the manufacturer and on receipt of the entire sale consideration, he has paid the commission to me in INR.

I have not registered with Service tax nor charged any service tax.

I have received notice from Service tax dept in reference to audit of accounts of the manufacturer and show cause notice has been issued for non registration, non filing of return and non payment of Service Tax

Pls advise the applicability of service tax and course of action to be followed by me.

Procedure to be followed

A client of mine has been registered for two services. He has started a new service, which is not intimated to the ST authorities. ST has been paid on the same. He has collected ST for Five half years but olny two returns for second and third half year have been filed till now. The income mentioned in the returns do not match the books. Return for the first first half year has not been filed. and there is tax payable in first half year. As on today, everything is paid. but if i review per half year, the scenario is different, payable in one return and refundable in another return.

My question is, can i revise the return he has already filed? Period of two months has passed from the date of filing of the original return. Can I ask the authority to consider his case afresh and file all the returns again with the correct position? We are submitting the intimation for the new service now in form ST-3 as amendment

I have a business wherein commission is received for facilitating purchase and sale transactons for parties located outside India (both outside India) and the commission is received in foreign exchange.

Please advise whether :-
a) Is it necessary to register with Service Tax Authority ?
b) Is there any service tax payable on above transaction ?
c) Is it necessary to file any service tax return

What is the 'Pay Cenvat from Service Tax'?
and What is the 'Pay Service Tax from Cenvat'?
Plz explain it by giving an practical example.

ST-3 Return

It is clear that GR-7 is to be submitted alongwith the ST3 for but GR 7 should be submitted in original or xerox copy.Pl clarify.

applicability of service tax

Dear All,

My client gives helicopter on rent. Whether applicability of service tax arises?He got a notice from excise department raising demand of service tax.After getting notice he resigtered under "Supply of tangible goods" and paid the service tax liability. Now, he want to go for appeal.Pls suggest.

Service Tax Return

What documents will be needed to submit along with the Form ST-3 under Service tax.
Whether working of Service tax is to be submitted with the return copy. The original GR 7 needed to be submitted or photo copy is to be submitted.

We are contractors for construction of residential building. We purchase steel, cement as prime material to be used in construction of building where excise is leived on the purchases. Can this excise duty available for setting off the service tax liability.
