Input credit

Sir,

My employer is a NBFC [Non-Banking Finance Co.]mainly lending gold loans.

We have a consulting firm consists of CAs whose services are being availed on various aspects viz, framing of schemes,marketing strategies,audit advisory services and other similar services.

We are debiting the above mentioned expense
in " Consulting Fee ". We are making the payment to the party after TDS.

They are charging service tax on their bill.

Doubt : Can we take input tax credit of the above mentioned service tax against our service tax payable ?

Kindly advise.

St on amount refund

Our company is engaged in business of Property Developement. During the month of July.2011 we received an advance of Rs.10,00,000/- towards advance for booking for one apartment, we paid VAT and ST agst same to govt. Oct.2011 same booking cancelled by customer and we are ready to refund the amount.

My doubt is Whether we can reimburse VAT and ST to client. How we can refund the same from Dept.

Please advise me

Dear Sir,

I would like to know as to Service Taxes will be paid whether on receipt basis or billing basis for bills which are raised before April 11 amendment (i.e to pay Service Tax to be paid on billing or receipt whichever is earlier)

Bills have been raised to the party before April 11 however there are no receipts from the party.Hence Service Taxes are not paid as the amendment is w.e.f April 11.

So is it fine to pay Service Tax on receipt basis for bills raised prior to amendment.

Exemption limit under service tax

One of my client is running commercial and computer training centre.He has registered in service tax in oct,2008. He has undertaken govt.training work for which he receives amount from the Govt dept after deducting royalty.
The bills are raised by the service provider i e single bill is raised and he does not have a all copies of the bills raised by him.
He has charged and collected service tax in certain bills and has not charged nor collected service tax in all other bills, in some bills he has charged but dept has not paid the service tax amount.
sir my query is that when only tax is charged in one or two bills, whether i am eligible for exemption limit under service tax kindly note that i do not have all the copies of invioces. its really urgent

Abatement -reg

we are in civil construction company and we consrtruct the building for trust so the trust property exemption for service tax ok but our subconntractor raise the bill and put service tax, i ask the contractor he told iam not working with trust, iam working with u so service tax is applicable. how can i compromise the party pl clarify

Avices. Then can we pay sevice tax on the above part of services separately ? Will the road portion will be exempted ? Can we take cenvat credit of dumpers for the service part of Eath formation and excavation service
