Will anybody please take the pains to explain in detail about claim for depreciation on plants and machinery in Income Tax. How this is related to Cenvat Credit? How deprecation is claimed and why? Is there any formula? I only know that these two benefits cannot be claimed simultaneously.

plz answer the few questions on excise:-
1. what will be the treatment of Cenvat credit availed on input services and capital goods used for the production of final goods which are exempted by a notificatin subsequently?
2. if exempted goods exported to EOU and Cenvat credit taken on inputs, then, will the cenvat credit taken be reversed?
3.which returns are filed by Input service provider, First stage dealer and second stage dealer?
4.what is the accounting treatment of cenvat credit available unutilised at the year end?

If the 100% EOU pays the Excise Duty under rule 8 of C.Exc rule 2002 than formula for calculating Excise Duty is applicable or not?
If no than can we avail full Cenvat Credit mentioned on Excise Invoice of 100% EOU?
(In this case We are DTA & material (Inputs) supplied by 100% EOU)

If an assessee,as a result of a genuine calculation mistake, debits an amount, which is in excess of the duty requirement, how he can get back the excess amount? If it is a four months old case, is the adjustment to be done through re-crediting the same in the Cenvat Account or by submitting Refund Application or? Who is the proper authority here? Superintendent or Assistant Commissioner? What are the governing rules / notifications?

Dear Experts,
In the year 09-10 we have taken a CENVAT credit(1st 50%) amount of Rs.50,000.00 for a certain capital goods. And next financial year (i.e 10-11) we have taken again balance 50% i.e 50,000.
But the actual amount is 60,000.00 insted of 50,000.00
Now can we take balance 20,000.00 together.
Kindly confirm me.

Capital Goods were removed (not as a scrap) in the 2nd year of purchase after having used it. In the first year 50% of Cenvat Credit availed. The assessee wants to avail the remaining 50% in the next year and then calculation for reversal according to Rule 3(5) of CC Rules is made. Can he do so? As the capital Goods were removed in the immediately next year of purchase and the Capital goods were not in the possession of the assessee during that FY i.e. the 2nd year. Whether the entire remaining amount of CC of 50% has to be reversed or reversal has to be made by reducing the amount of duty by 2.5% quarterly basis.
