CVD

Ours is a manufacturing company having domestic as well as export sales. we are importing raw material by paying 5% customs duty 10% CVD and 4% Additional duty. CVD and Adl.duty are eligible for Cenvat credit. As our export is duty free our accumulation on cenvat credit is more can we claim refund or can we charge duty on export and avail rebate for export? please suggest

Normally what is the effective date of any notification? There is a notification (No. 12/2011-Central Excise (N.T.))regarding assessible value for the purpose of excise of hosiery goods dated 24.03.2011. As per the notification, Assessible value for the purpose of excise shall be 45% of MRP instead of 60%. I want to know the effectifive date of this notification. Is it applicable on and after 24.03.2011 or after 24.03.2011(i.e. from 25.03.2011)? please help me.

Registration of a SSI Unit

Excise Registration of SSI Manufacturing Units situated at Different Places under same Management:

• A SSI Unit (Unit I) is already registered under Excise and carrying out Manufacturing activities on own account.
• Now, plans to start manufacturing activities at another existing Unit (Unit II), situated at different Place. Presently carrying out only Sub contract work to a Manufacturing unit on Labour charges.

Clarification sought for the Excise Registration of Unit II:

• Proposes, to adding of some material to the material received from the principal manufacturer and return the material back after certain process.
• The expected Turnover (Labour Charges Material) is less than 1crore per annum.
• Whether Unit II is to get itself registered under Excise, as Unit I, is already registered Under Excise.
• Can we claim exemption from excise registration as the activities are not inter connected.
• Applicability of Notification No 214/1986 CE dtd 25/03/1986 to Unit II.

my query is regarding difference in physical stock of raw material with RG 23 A PART I , if issue of raw material is made on the basis of standard ratio of industries , but actual consuption of material is may differ from standard ratio , due to this physical stock may increased , please suggest how to treat excess physical stock

Can a dealer in excisable goods could avail/pass on cenvat credit on stock-in-trade laying in his premises before obtaining registration.

Please mention if any specific provision in this regard.

journal enty-PLA ??

hello everyone,

i have doubt regarding passing of journal entry in case of excise duty.

what i understood from my friend is as under.

on 01/04/2011 the co. has paid Rs.100000/- as PLA.
PLA dr-100000
to bank-100000

suppose: excise payble for the month comes to Rs.200000 & cenvat credit available is Rs.50000

excise payble dr-200000
to PLA-100000
to bank-50000
to cenvat receivable-50000

are above entry correct.

WE ARE MANUFACTURER ONE OF OUR PARTY HAVE GIVEN US CT3 FORM IN THIS FORM THEY HAVE SHOWN EXCISE DUTY OF 10.3%
AND IN PURCHASE ORDER HE HAD NOT GIVEN DUTY NOW HOW I SAND HIM GOODS WHIT EXCISE OR NOT TO CHARGE EXCISE TO HIM IN INVOICE PLEASE SHOW ME WAY HOW I SEND GOODS TO HIM WITH EXCISE OR WITHOUT EXCISE
