RESPECTED SIR...
OUR COMPANY IS A MFG OF BOTH EXCISABLE & NON EXCISABLE PRODUCT..& WE ARE PAYING THE INTERNAL AUDIT FEES,MANAGEMENT CONSULTANT FEES,LABOUR SUPPLYING CONTRACTOR (LABOUR ARE USED FOR BOTH EXCISABLE WORK & NON EXCISABLE WORK & THERE IS NO SPECIFIC IDENTIFICATION REGARDING TO UTILISATION OF LABOUR IN VARIOUS SERVICES) ETC SO MY QUERY IS THAT ....
WHETHER WE CAN CLAIM CENVAT CREDIT ON SERVICE TAX PAID TO INTERNAL AUDITORS,TAX CONSULTANTS,& LABOUR SUPPLYING CONTRACTOR
(IN SEC 6 OF EXCISE ACT THERE IS ONLY 16 SPECIFIED SERVICES ON WHICH WE CAN CLAIM CENVAT)

WHETHER INTERNAL AUDITORS,TAX CONSULTANTS COMES UNDER THE CATEGORY OF MANAGEMENT CONSULTANTS....

Excise - valuation

Please inform me on the following query ASAP.

A company after manufacturing goods, sale the same goods to another company. The buyer company does not take delivery of the said goods on time. Selling company charges delay charges for the same. Whether these delay charges will be a part of assessable value for excise duty purpose? I need a case laws for the same. It will be great i some one help me on urgent basis.

Excise set off query

Dear sir,

My Unit is Manufacturing unit. i am Year ended purchase one machinery in Gujarat this purchases bill is a 10% excise duty, 2% edu.cess, 1% HS edu.cess, but i confused what is set off of machinery

We are the first stage dealer. We are maintaining RG23D register in SAP as well as in hard copy.
My query is according to which central excise rules it is compulsary to maintain RG23d register?
If there is any notification or circular regarding this then please give details of it.

Export under bond

We are purchasing the material under main chapter head 39 and without any process on the same we export the same material. But to tender the customers requirement we have to change the name of the product, accordingly the packing slip while exporting is changed. How can we avail the duty refund on such export?

Problem in e-filling dealer return

DEAR SIR,

I am registered as traders and importer also i have duty credit taken
own import document,

When we are uploading the the dealer return on ACES.GOV.IN its give massage Rejected stating "assessee can not entered his owe registration no. in document based on which the credit passess".
We importing the goods against B/E, the in the col. of reg. the assessee's own no. is to filled only.

one of our customer from singapore inquire about ship spares which is supplied at sikka gujrat & our company is at mumbai.

please advice as any tax such as vat or service tax include in our invoice as it treated as export.

Noti. no. 1/2011-ce dt 1.3.2011

Dear Sir

We are mfr of Branded Jewellery (71131930 & 71131940). We have crossed limit of 1.5 crores. We are charging 1 % BED and relevant cesses. We also take relevant Cenvat credit of Input Service. We are showing in ER 1, Noti. No. 1/2011-CE dated 1.3.2011 (Sr.No.88).

Now, we have a doubt. 1% Excise is chargeable only if assessee do not take any credit of Input of Raw Material and Input Services. If you are taking cenvat credit, then you cannot charge 1 % BED. Instead, you should charge full rate of BED.
Now, pl. study this and let me know, whether we are correct on charging of 1% ? or we should charge full BED. IF SO, WHAT IS THE FULL RATE OF bed ON THE CHAPTER HEADING MENTIONED ABOVE.
