Ex depot price

Sir,

what is the meaning of ex-depot price for the purpose of excise in case goods are sold from factory to warehouse, depot or some other place on consignment basis.....???

Dear Experts

WE are a 100% EOU in Hyderabad.

Our company has imported r/m from china thru their Mumbai agents / office. After receipt of goods at Hyderabad, we have got the procurement certificate and filed Bill of entry also.

We have entered this transaction in our B-17 bond also. But at the last moment, the consignment was not released because of difference in the invoice value which was used in all these filings.

The thing is we have filed the procurement
with the manufactureres invoice with a lower value instead of the vendor invoice which will be higher value. But subsequently, we have got the vendor invoice thru bank and paid that value (higher value) to the bank.

Amending the procurement and bill of entry eats up lot of time and also should pass thru several officials at Hyderabad and Mumbai level and we have to incur demurrhage charges to the liners.

Pls suggest any alternate ways to get our consignment cleared soon.

An Indian Customer C places an order on overseas supplier S1 to import a machine + Automation system.

S1 will export the machine to C in India & will outsource the automation system from an indian supplier S2 who will deliver the system to the customer C directly. S2 will get paid by S1 in foreign currency.

1)Can this transaction between S1 & S2 be treated as deemed export ?
2)What will be the impact of taxes & duties ? Will excise duty, VAT etc be applicable on the automation system from S2 to C ?

Would appreciate an early reply from you.

Interemediary Goods Exempt

Hello experts,
Namaste!

I have a querry in the matter of exemption of intermediary goods used for manufacture of final product,(both final product and intermediary products are dutiable) which is it self dutiable but due to the exemption Notification No.50 /2003 of Central Excise , Dtd-10th June,2003(which applicabe to us/we are taking benefit) we are not paying duty.

In this case whether we shall have to pay duty on intermediary goods as per NOTIFICATION 67/95 of Central Excise.

Actually we have an unit at Himachal Pradesh notified exempted area(n.n.50/2003). where we manufacture battery which is dutiable but due to the said notification no. we are not paying duty on battery. But we used the intermediary(grey oxide)which is also dutiable goods.
1.My question is whether we have to pay duty on grey oxide or not?
2.Whether grey oxide comes in negative list of goods.
3.If grey oxide is in negative list , then whether there will be any change in the implementation of above notification.

job work

If a principal importer imported some material and after that they sent the same to a other premises for job work only through Annexuture-II .Would the main Importer can take the Cenvat Credit from that Imported inputs?

Education cess & SHEC is applicable or not on service tax of Air Travel Agents if not please give notification of service tax. some people say education cess & SHEC is not applicable for this category of service tax, but as per our knowledge Service tax on air travel agents is 0.6% for Domestic tkt booking & 1.20% for International tkt booking in addition education cess @ 2% & SHEC @ 1%.

if those person is right for E.Cess & SHEC then plz give the date when education cess & SHEC is not applicable as per service tax notification.

Iam a accountant of a Garment Factory.We are manufacturing Ready made garments.Is excise duty leviable on this manufacture.Is there any slab ie; turnover limit for Excise duty liability.Last year we made around 4 crore turnover.What is procedure for excise duty levy?
