Applicability of exise

sir we are manufacturing goods but i can not sell the goods immedieately. we are store the goods to warehouse whether exicse duty applicable?

Who is the defaulting person (whether the directors of company or an employee who handles tax matters) and liable to prosecution under various tax laws like excise, customs etc??

Excise input

A manufacturing company purchase raw material from supplier and convert raw material into finished product,,,, and also doing trading of raw material,,,,

My question is that can enterprises take input of excise on trading activities????

Plz answer,,,,,

1)whether conversion of iron wire into nails amount to manufacturing .

2) if one party purchases iron wire and gives to another party for conversion into nails whether job work involved there. please explain the concept of job work.and how it can be accounted in both the party books.

Excise registration

Dear Sir,
One of my client has receivable of Rs. 18 lakhs (appx) from one manufacturer of iron n steel, now the said debtor told us to take scrap from him as against the outstanding amount.
But, in that he will charge excise from us on the value. Presently we dont have excise registation because we are work contractor and trader.
should we get ourself registered under the excise law for excise duty credit or any other option is available to us.

Dear Experts,
we have transferred a capital asset, on which we have not taken the excise credit, to another branch.
now we have to issue an invoice u/r 11 of C.Ex.Rules 2002 for the transfer purpose and for receiving Form F under VAT laws.
The question is that whether i have to show the Excise duty amount in the invoice or not since credit has not been taken by us previous to transfer.

Hello all Please tell me trading of goods (goods which are not manufactured by assesse) is also includible in the SSI Limit i.e. 150 Lakhs for example, if an assessee manufactures goods valued 120 Lakhs. In addition he sells the goods manufactured by other manufacturer for 50 Lakhs. In this case, what is his total turnover for the SSI purpose? Is he liable to get registered under excise Law??

Cenvat

Sir our coal tar mfg factory is in Bihar.
We purchase coal from jharkhand and pay service tax on carriage inward.
As we are manufacturer of Coal tar, we have to pay excise on mfg of coal tar.

whether we can utilized input service on payment of excise duty on manufacture of coal tar.

Cenvat on capital goods (motor)

We have purchased a Motor Rs. 25200 falling under chapter 84 as replacement of damaged motor.

Our consultant advise us the following :-

1) We can take 50% cenvat credit by capatalised this motor.
2) We can not take cenvat credit if we show it as repair & maint.

What will be the audit's objection if we post the entries in both the situations.

Please advise us to remove this confusion.
