Benefits to SEZ Developer/ Unit

This query is : Resolved

17 March 2010 Dear All,

We are one of the Multi-Product SEZ Developer in Gujarat.

Our case is mentioned as below:

1) We have contracted company "A", for a setting up Switch Yard in SEZ.

2) Company "A" has ordered one of the main equipments on manufacturer "B" & is an Excisable Unit for requirement of setting up Switch Yard in SEZ.

Our queries are as below:

1. As an SEZ Developer, can we claim any Export benefits? If so, under which provisions/ rule?

Contractor "A" and manufacturer "B" are ready to give Disclaimer in our (SEZ) favour.

2. How Bill of Export will be filed & on whose name?

Commercial Invoice would be submitted by "A" and payment would be made to them by us (SEZ). Therefore, only "A" would be able to provide us BRC once the payment is released.

We request all Industry Experts to Guide us in this regards.

Warm Regards,
Vishal Trivedi

18 July 2024 In the context of being a Multi-Product SEZ Developer in Gujarat, your queries pertain to claiming export benefits and handling the process of exports within the SEZ framework. Here’s a detailed response to each of your queries:

### Query 1: Claiming Export Benefits as an SEZ Developer

As an SEZ Developer, you can indeed claim certain benefits related to exports under the SEZ Act and Rules. Here’s how it typically works:

1. **Supply of Goods or Services to SEZ Units:**
- When you, as an SEZ Developer, supply goods or services to SEZ Units (like Company "A" in your case), these transactions are treated as exports.
- Since SEZs are considered to be outside the customs territory of India for the purpose of trade operations, supplies from the Domestic Tariff Area (DTA) to SEZ Units are treated as exports.

2. **Benefits Available:**
- **Duty Exemption:** You may be eligible for exemptions from customs duty, excise duty, and service tax (now GST) on goods and services supplied to SEZ Units.
- **Income Tax Benefits:** Income derived from business activities in SEZs may be eligible for income tax exemptions under Section 10AA of the Income Tax Act.

3. **Documentation and Compliance:**
- To avail these benefits, proper documentation is crucial:
- Obtain a Disclaimer Certificate from Company "A" stating that goods/services supplied by you are intended for setting up the Switch Yard in SEZ.
- Maintain records of invoices, shipping bills, and other relevant documents.

### Query 2: Procedure for Export Documentation and BRC (Bank Realization Certificate)

1. **Bill of Export Filing:**
- The Bill of Export needs to be filed by the supplier (in this case, Company "A" or the manufacturer "B" if they are exporting directly).
- The commercial invoice would typically be issued by Company "A" (the contractor) for the goods supplied to you (SEZ Developer).
- Ensure that the commercial invoice indicates that the goods are supplied to an SEZ Developer and are for use within the SEZ.

2. **Name on Bill of Export:**
- The Bill of Export should ideally be filed by the exporter (Company "A" or manufacturer "B"), who is exporting the goods out of India.
- Since payment is made to Company "A" by you (SEZ Developer), they would be responsible for providing the Bank Realization Certificate (BRC) upon receipt of payment.

3. **Bank Realization Certificate (BRC):**
- The BRC is issued by the authorized dealer (bank) upon realization of export proceeds.
- Company "A", being the exporter, would need to submit the BRC to you (SEZ Developer) once they receive the payment from you.
- Ensure that the BRC clearly reflects the export transaction related to the goods supplied for the SEZ project.

### Conclusion:

As an SEZ Developer in Gujarat, you can claim export benefits for goods and services supplied to SEZ Units like Company "A". Ensure compliance with SEZ Act and Rules, maintain proper documentation, and coordinate effectively with Company "A" and manufacturer "B" to streamline the export process and claim benefits appropriately. Seek guidance from SEZ authorities or industry experts for specific details based on your operational setup and transactions.
