01 February 2015 As per the companies act 2013.company having paid up capital of Rs 5 cr or more that time appointment of whole time company secretary is compulsory.

1.what is the penalty available to the company having paid up capital Rs 5 cr or more.--- if company not appointment whole time company secretary, and get compliance to the Roc from the PRACTISING CS. PCS having the knowledge about non appointment of whole time appointment of cs.
what is the responsibility of company and pcs also who render that service?

02 February 2015 Penalty

1. Non appointment of CS (Regarded as Kmp)under section 203 OF THE COMPANIES ACT, 2013
Penalty on company

Minimum penaly is Rs. 1 Lakh
Maximum penalty is Rs. 5 Lakhs

Penalty on director & kmp of defaulting company

Rs. 50,000/- and further fine of Rs. 1000 per day during which such default continue

THAT WHICH AUTHORITY SENT NOTICE/INTERVENTION/ORDER TO APPOINT WHOLE TIME COMPANY SECRETARY ??
