if the paid up capital of a company is more than 5 crore , can it appoint practising company secretary on retainership basis instead of whole time cs , if yes which section of companies act allows it to do that

Dear Ruchi As far as i think all companies whose paid up capital is more than Rs 5 crore need to appoint a full time company secretary . Otherwise all relevant document need to certified by a practicing company secretary . Thanks

If the paid up capital of a company is more than Rs. 5 crore , it require to appoint company secretary whole time basis under sec.383(A) of companies act,1956. Non compliance of this sec. attarct penalty provision. it is legally fine that you get all the documents certified by practising company secretary untill the company not appoint the CS on wholetime basis.
