Sir, I need to appoint an auditor in the non-government private company. I have to appoint at the AGM, the new auditors instead of re appointing the retiring auditor. Sir, i want to know that... what will be the period of new auditor, if appointed on the AGM held on 30.09.2016. And whether it is a case of casual vacancy or someone else?

1. 5 years , with yearly ratification in AGM
2. Not a casual vacancy.
3.Appointment of new auditor has to be done as an 'ordinary resolution' , but special business, which requires special notice u/s 140(4)(i) r.w.s.115 and explanatory statement u/s 102.

Thank You Sir, But, if i appoint the auditor subject to the casual vacancy in Dec 2016, after the AGM held on 30.09.2016. Then, will the period be for the next AGM or for 5 Years.
