24 December 2015 Dear all experts,
Day before yesterday i had posted A query but two experts had replyed my query differently therefore i remain in confussion plz clarify if possible here's my query....
A Flats construction company has hired A engineer to review the flat's construction however the expenses incurred in relation to lodging, fooding, travelling of engineer will be reimburse him later also company will made the TDS u/s 194J on payment made to him .1) weather the company is liable to pay ST under RCM on service taken by engineer if not why......2) as per
amended in section 67 service tax should be payable on reimbursement of exp. But engineer is not registered in ST, in this case weather company has to Pay ST on reimbursement of exp. Under RCM or not if not why......

24 December 2015 1 The company is not liable for RCM for the service provided by the engineer as this service is not covered under RCM,
2 Even engineer is not registered under ST company is not liable to pay service tax under RCM for reimbursements..
