As per the provision of this section "New regular workmen employed during the previous year "
For Eg: For the financial Yr 2011- 12 an employee who has worked for more than 300 days but appointed in the year 2010- 11 who was not eligible then, can he be considered as a new regular employee for 2011- 12 since he satisfies the condition of 300 days during the current Financial year ?

As per the term Eligibility means, new employee should be recruited during the financial year. Last year employees were not eligible in previous year but they are in the company as an employee. In short, they are not eligible.
