21 April 2012 As an auditor can we take declaration from directors u/s 274(1)(g)after March 31 for the concerned period.
I.e. for audit period ended March 31, 2012 can the declaration by director be in month of April 2012.
Please give your comments asap.

21 April 2012 You can get the declaration in the month of april provided the date of declaration is 31st March 2012.

As per section 299 of the Companies Act, 1956, every present director will give to the company in last month of financial year disclosure of their interest in other company.

This special notice will be taken in to notice by Board of Director in meeting hold after end of financial year.

For Auditor, they just only check from the records availabe for audit that the all director have given their disclosure and also check that he/she is not disqualified from 274(1) (g) .

Director give this declaration under section 274(1) (g) at the time of appointment of such person as director and the same will be kept by company and available for auditor to check and give their report thereon.

Ajay@ for auditor the date of declaration is to be as on balance sheet date. i guess. as m facing such issue and want an concrete back up.
