If an assessee by mistake deposits service tax in the wrong accounting head,which is not applicable to him, then what is the remedy ?

04 September 2010 The department have clarifed that if the assessee has used a wrong accounting code, the assessee need not asked to pay service tax again and that the matter should be sorted out with the P.A.O and that in case where the assessee was asked to pay the service tax again, the amount thus paid may be refunded by the concerned divisional A.C/D.C- Ref: CBEC circular No.58/07/2003-CX(ST) dt:20.5.2003 this cicular has been superseded vide Circular No.97/8/2007 ST DT:23.8.2007

05 September 2010 dear ramesh,

i hav gone through cicular no.58/2003 & cicular no.97/2007 both. but , i have witnessed that nothing is mentioned in circular no.97/2007. could u plz send me clarifying doc as attachment
